What is Mediation?

Mediation is not a legal service or a counseling service.  Mediators provide guidance to all parties involved in the resolution of a problem, allowing them to retain control over the ultimate decisions.  Mediators know how to deal with stresses involved in a conflict and develop and support a productive problem-solving process.  Mediation can be used for any conflict or dispute.  There are some common areas where mediation is helpful.

 

FAMILY MEDIATION

Some of the most difficult types of conflict to resolve are those that happen in a family.  When family members are caught up in the upheaval of life-changing events, resolution can seem impossible. As a mediator I can effectively resolve family issues like:

§  Child custody decisions

§  Blended family issues

§  Elder care

§  Adoption

§  Post-divorce conflict

§  Estate arrangements

§  Premarital preparation

§  Parent-Teen Problems

§  Education matters

 

DIVORCE MEDIATION

Divorce mediation is a very different process that divorce litigation, which is a public, adversarial process where the parties can end up before a judge in open court. This adversarial process can create a lot of hostility and make things feel out of your control.  Divorce mediation gives you the chance to work out, in private, all the details of a divorce that creates a plan for the future that is mutually agreeable for the future.  My training as a counselor and a mediator allows me to be comfortable with the strong emotions that are part of divorce while focusing beyond the emotions to a workable agreement. Divorce mediation can help with issues like:

§  Distribution of Property

§  Child Custody

§  Child Support

§  Retirement

§  Taxes

§  Spousal Support

 

CIVIL AND COMMERICIAL MEDIATION

Mediation can place before or after any legal action is initiated.  Usually, mediation result in a memorandum of understanding that outlines the points of agreement between the parties. It is not considered binding until both sides have had an opportunity for an attorney review.  So mediation is not a substitute for legal representation; instead mediators work with attorneys and their clients to come to a mutually agreeable decision outside of court
